A city consumer court has found Kolors Healthcare guilty of deficient service for failing to help a customer, Kalai Arsan, lose 12kg as promised through its weight loss program. The IV Additional District Consumer Disputes Redressal Commission has ordered the healthcare facility to refund Rs 40,735 from the Rs 42,000 Arsan paid for the program, along with Rs 10,000 for mental agony and pain caused, and an additional Rs 10,000 towards litigation costs.
Arsan, a resident of Bharati Nagar, enrolled in Kolors’ weight loss program in late 2023, after being promised a 12kg weight loss. Despite following the prescribed diet and instructions, he did not lose the expected weight. He raised multiple complaints with the facility, which were ignored. After sending a legal notice in January, which went unanswered, Arsan approached the consumer court in March, seeking a refund and compensation for the distress caused.
Kolors Healthcare denied the allegations, claiming Arsan had not followed the treatment guidelines and had abruptly discontinued the program. However, the commission ruled that the company had failed to deliver the promised results, finding it guilty of deficient service. The commission also noted that Arsan had attended 11 of the prescribed 365-day treatment sessions. Kolors was instructed to refund the remaining amount, with interest, and compensate for the distress caused.
